These Terms of Service ("Terms") govern your access to and use of Talovex (the "Service"), operated by Smart Technology Investments LLC ("Company," "we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using Talovex, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Talovex uses federal repayment plan parameters from studentaid.gov, HHS poverty guidelines, BLS occupational wage data, IRS tax tables, and Monte Carlo simulation to help borrowers compare federal student loan repayment plans. The Service provides NPV cost comparisons, PSLF breakeven analysis, tax bomb modeling, and income trajectory simulations. The Service is informational only.

3. Not Financial Advice

Talovex is not a licensed financial advisor, loan counselor, or tax professional. The plan comparisons and cost estimates provided are based on publicly available federal data and statistical models. They do not constitute recommendations to select, change, or decline any specific repayment plan.

You should always:

Verify plan details directly with your loan servicer before changing plans
Consult a qualified financial advisor for personalized guidance
Review the terms of each repayment plan on studentaid.gov
Consider consulting a tax professional regarding forgiveness tax implications

4. Data Accuracy Disclaimer

Our cost estimates are derived from Federal Student Aid plan parameters, HHS poverty guidelines, BLS wage data, and IRS tax brackets that are updated on their own schedules. We do not guarantee the accuracy, completeness, timeliness, or fitness for any particular purpose of data derived from third-party sources.

Cost estimates are probabilistic, not guarantees. Monte Carlo simulations model income uncertainty and produce ranges of possible outcomes. Your actual repayment cost may differ materially from our estimates due to income changes, legislative changes to repayment plans, interest rate adjustments, or changes to forgiveness programs.

5. Permitted Use

You may use the Service for lawful personal or commercial research purposes. You agree not to:

Reproduce, resell, or sublicense our optimization outputs without a commercial license
Scrape or systematically extract data from the Site beyond API rate limits
Represent our data as official government data or as financial advice
Attempt to reverse-engineer our optimization algorithms or scoring methodology
Use the Service to harass, defame, or harm any person or entity

6. Credits and Billing

Talovex uses a per-report credit system. Credits are purchased as one-time payments (not subscriptions) via Stripe. Single reports cost 1 credit ($12), report packs provide 3 credits ($29), and API credit packs are available for developers and financial advisors. All fees are in U.S. dollars and are non-refundable except as required by applicable law. We may change pricing with 30 days' notice.

7. API Access

API subscribers receive API access subject to rate limits specified in the API documentation. API credentials are non-transferable. You are responsible for securing your API keys. We reserve the right to suspend API access for abuse or excessive usage.

8. Intellectual Property

The Service, including its design, optimization methodology, software, and compiled data outputs, is owned by Smart Technology Investments LLC and protected by copyright and other intellectual property laws. The underlying government datasets are in the public domain. Our original expression, analysis, and optimization methodology are proprietary.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART TECHNOLOGY INVESTMENTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association.

12. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or prominent Site notice. Continued use after the effective date constitutes acceptance of the revised Terms.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Technology Investments LLC with respect to the Service.
